29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: The employer does not ensure that personal protective equipment is worn when operating an excavator. This violation was observed on or about August 21, 2012, in a residential area where employees were exposed to an ejection hazard when operating a Bobcat 311 excavator without donning the seatbelt.
