29 CFR 1910.178(g)(11): Precautions were not taken to prevent open flames, sparks, or electric arcs in battery charging area(s): a) Warehouse: On or about 08/27/2012, the Helmar Inc., Power Point Three Phase Battery Charger (Serial #0078139-2006M & Serial # 0064009-2006E) units charging cables were submerged in water and connected to a Yale Forklift (Model# ERC0550GHN36TE084 & Serial # A908N04023D) creating an electrical hazard. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.106(d)(6)(iv): Storage areas for flammable or combustible liquids were not protected against tampering or trespassers where necessary and were not kept free of weeds, debris and other combustible material not necessary to the storage: a) Receiving yard outside of the warehouse: On or about 08/27/2012, the employer stored twelve (12) propane tanks in an unlocked metal storage cage that was not secured to prevent against tampering by trespassers. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
