Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by traffic hazards. On or about August 20, 2012-Job Site at 2560 Borough Place Astoria, NY 11104 a) Employee working in the road was adjusting the straps on the truck, preparing to load the truck, did not set up a shifting taper with cones to move traffic away from his work area in live traffic. WRITTEN ABATEMENT DOCUMENTATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
