29 CFR 1926.652(c)(4)(ii)(A): Designs were not in written form and did not include a plan indicating the sizes, types, and configurations of the materials to be used in the protective system: (a) L. D'Agostini & Sons, Inc. on or about August 20, 2012, at the site address of 250 Edwin Dr. Toledo, OH: The employer failed to ensure that the protective shoring system installed around Man Hole #1 was constructed under the direction of engineered designs, identifying the specifications such as: sizes, types and configurations of materials used. Without this engineered data, employees are unable to effectively assess the parameters in which the protective system may be safe to utilize.

29 CFR 1926.652(c)(4)(iii): At least one copy of the design by the register professional engineer was not maintained at the jobsite during construction of the protective system. a) L. D'Agostini & Sons, Inc. on or about August 20, 2012, at the site address of 250 Edwin Dr. Toledo, OH: The employer failed to ensure a written copy of the protective shoring system design (at Man Hole#1) was developed prior to and maintained onsite during the installation of the system. Due to this condition, inadequacies in the protective systems' installation and construction were found during employee use. Employees were exposed to potential cave-in hazards while performing work task in the confines of the shoring system that had not been constructed under a Professional Engineer's certified plans.
