29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. Jobsite - On or about August 23, 2012 employee was operating a Caterpillar TH63 telehandler while not wearing seatbelt.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with: One stairrail system along each unprotected side or edge. Jobsite - On or about August 23, 2012 employees used metal stairs with 4 risers to enter and exit a job storage trailer which was 47 inches to the floor. The stairs were not equipped with stairrails on each unprotected side to enter and exit.
