29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. (a) The employer did not ensure that an employee was using a safe means of access and egress into and out of an excavation. The employee was exposed to a fall hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) The employer did not ensure that an employee was using fall protection. The employee gained access to an incomplete manhole system by walking across the top of an approximate 8' high trench shield and then into the incomplete manhole system. The employee was exposed to a fall hazard.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: 29 CFR 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. (a) The employer did not ensure that an employee was using protection when working in an excavation. The employee was cleaning out the bottom of an incomplete manhole system and was exposed to a struck-by hazard and a caught-in-between hazard.
