29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph. a) Gillete Masonry, Inc. / Panera Bread location /4014 Peach Street in Erie, PA: On or about August 21, 2012 personnel were on a tubular welded frame scaffold approximately 14-feet above ground level performing bricklaying operations. The scaffolding did not have complete sets of top rails and mid-rails.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: a) Gillete Masonry, Inc. / Panera Bread location / 4014 Peach Street in Erie, PA: On or about August 21, 2012, personnel were on a tubular welded frame scaffold approximately 14-feet above ground level performing bricklayer operations. Workers and other site personnel were working directly below and walking underneath the scaffold. Falling object protection was not installed and utilized on, around, and or with the scaffold.
