29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) At the worksite, the employer did not ensure/enforce that employees used fall protection while performing framing task such as, but not limited to preping third story walls to set while working from the outer top plate edge, thereby exposing employees to an approximate 25 foot fall hazard.

29 CFR 1926.503(c)(3): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. a) On the site, the employer did not ensure that employees, that were performing framing work from the outer top plate edge, were clear on the requirements for fall protection.
