29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Residential jobsite: On August 10, 2012 an employee did not wear a hard hat when walking and/or working under a ladder jack scaffold system where siding activities were being performed above.      Note) Abatement certification IS required for this item.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level:    a) Outside of residential structure: On August 10, 2012 and at times prior thereto Earthworks II Construction & Excavating, LLC did not ensure its sub-contractor protected themselves from a 19 foot fall hazard to the ground below.  The sub-contractor performed siding activities from a ladder jack scaffold system without a fall protection system in place.      Note) Abatement certification IS required for this item.
