29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) Rooftop - On or about August 22, 2012, when using a pneumatic nail gun to install roof shingles employer did not ensure the use of eye protection, thus exposing the employee  eye injuries from ricocheting and flying debris.     ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a)  Residential rooftop left elevation - On or about August 22, 2012, an employee was installing roof shingles on a 8-in-12 pitch roof without the use of fall protection such as, but not limited to, guardrail system with toe-boards, safety net system or personal fall arrest system (PFAS), thus exposing the employees to a fall hazard up to 20 feet 6 inches.    b)  Residential rooftop front elevation - On or about August 22, 2012, an employee was pre-placing shingles on a 8-in-12 pitch roof without the use of fall protection such as, but not limited to, guardrail system with toe-boards, safety net system or personal fall arrest systems (PFAS), thus exposing the employees to a fall hazard up to 11 feet 6 inches.    ABATEMENT CIRTIFICATION IS NOT REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a) Front elevation - On or about August 22, 2012, employees were observed traversing the roof eave using an unsecured extension ladder. The extension ladder was positioned at the roof eave and did not extend 3-feet beyond the roof edge, thus exposing employees to a fall hazard up to 11-feet 6-inches.    ABATEMENT CERTIFICATION IS NOT REQUIRED.
