On or about 08-24-12 at 77521 Overseas Hwy Islamorada FL 33036, employees were using a scaffold that did not have mud sills, exposing employees to the hazard of falling approximately 22 feet to the ground.

29 CFR 1926.451(e)(1):  When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    On or about 08-24-12 at 77521 Overseas Hwy Islamorada FL, 33036, a fabricated frame scaffold was not provided with means of access while employees accessed the scaffold by climbing the frames of the scaffold, exposing employees to a fall hazard of approximately 22 feet to ground.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.    On or about 08-24-12 at 77521 Overseas Hwy, Islamorada Florida 33036, A fabricated frame scaffold was not inspected by a competent person prior to allowing employees to work from it.  The employees were exposed to a fall hazard of approximately 22 feet.  The scaffold was lacking mid rails, did not have mud sills and did not have proper access.

29 CFR 1926.451(g)(1)(vii):  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On or about 08-24-12 at 77521 Overseas Hwy Islamorada Florida 33036, employees were exposed to a fall hazard of approximately 22 feet to ground level while working from a scaffold that was lacking guardrails.

29 CFR 1926.454(a):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    On or about 08-24-12 at 77521 Overseas Hwy Islamorada Florida 33036, an employee, who was lacking training in the recognition of fall hazards, was exposed to a fall hazard of approximately 22 feet to ground level while working from scaffolding that was lacking guardrails.
