29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502: a) M J Construction at 8179 East 32nd Ave., Denver, CO 80238: On or before August 25, 2012, the employer did not ensure that an employee was using fall protection when working on the front porch roof to side the upper exterior wall of this two story single family home. The roof had a 5 in 12 pitch. Condition exposed this employee to a fall hazard of up to 11'3".
