29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) 1325-1335 Kennedy Blvd., at the entrance to the interior of the church under construction, Bayonne, NJ. Employees were exposed to "over-the-railing" falls of 15 feet to the basement below as the wire rope guardrails adjacent to the main temporary stairway were not at least 39 inches high. Violation observed on or about 08/24/2012.

Employees were exposed to falls of up to 15 feet to the concrete floor below as the stairrail system was missing its midrails on each side of the stairway. Violation observed on or about 08/24/2012.
