29 CFR 1926.652(a): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) An employee was working in a six foot four inch deep vertical trench that was partially dug out of previously disturbed soil and located adjacent to a traveled road and the employee was not protected from a potential cave-in as observed on August 22, 2012. ABATEMENT CERTIFICATION REQUIRED.
