29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM was begun; the employers did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: The general contractor did not determine the presence, location, and quantity of all asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site prior to allowing demolition work to being in the Lakeside building. a) New Northside Atlanta High School: On or about August 30, 2012 and at times prior to, JE Dunn Construction Company did not identify the presence, location and quantity of asbestos containing material and presumed asbestos containing matererial prior to demolition activites in the Lakeside building. JE Dunn Construction was previously cited for a violation of this occupational safety and health hazards standard or its equivalent 29 CFR 1926.1101 (k)(3)(i) in OSHA inspection number 310933632, citation number 01, item number 002 and was affirmed as a final order on June 7, 2010, with respect to a work place located at 2316 East Meyer Boulevard, Kansas City, MO 64132.
