29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used: On 08/27/2012, at an establishment located at 3605 Bahama Drive, Plano, Texas; on a three-by-three tier tubular welded frame scaffold, employees climbing scaffold end frames to access the second scaffold platform were exposed to a fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level: On 08/27/2012, at an establishment located at 3605 Bahama Drive, Plano, Texas; an employee handling mortar was standing on the second tier of a tubular welded frame scaffold and was exposed to a fall hazard. The scaffold was not provided with guardrails and the employees did not wear personal fall protection.
