OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting caught-in or between a tipping forklift and the ground:      a)  210 Hinterleiter Road Plant - Employees were exposed to crushing injuries in the event of a turn-over, from operating a forklift without wearing a seatbelt, on or about August 21, 2012. Seat belts in the forklift truck are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a tipover accident, a hazard to which forklift trucks are particularly susceptible, and that the failure to wear the seat belt that is provided in the forklift truck increases the risk of injury to the operator in the event of such an accident.        No abatement certification or documentation required.

OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to contact with/cutting hazards:    a)  Concrete Production Area - Employees were exposed to contact/cutting hazards from operating a concrete saw (Stihl model: TS 420) without proper training on the hazards of operating the saw improperly, on or about August 21, 2012. A temporary employee was operating the saw on a concrete wall when the saw kicked back and lacerated the employee's neck.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.23(c)(1):  Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:    a)  Concrete Production Area - Employees were exposed to fall hazards of 21 feet from accessing the top of the vertical forms to adjust tarps without any means of fall protection, on or about August 21, 2012.
