29 CFR 1926.852(a): Material was dropped to points lying outside the exterior walls of the structure which had not been effectively protected:      a) Loose and bagged debris, including ceramic tiles & metal mesh, from a gutted upstairs apartment bathroom were tossed out of a 2nd floor window by the contractor into the bed of his pick-up truck parked on the lawn below.  No barricades or cautionary signs of any kind were used to protect employee(s) on the ground from standing / walking within the drop area.    Condition(s) were noted on or about 8/08/2012.

29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM is begun; employers shall identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section.      a) The contractor performed a Gut / Rehab of the bathroom in the apartment above the leasing office of Mill Run at Union apartments; original construction of which was prior to 1980.  The work disturbed pipe insulation containing asbestos within the demolished wall(s), which was not identified by the contractor as presumed asbestos-containign material (PACM) to allow communication with employee(s) and prevention of exposure(s).    Condition(s) were noted on or about 8/08/2012.
