29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite - 1900 Poplar Street - Employees working on the tubular welded frame scaffold were exposed to fall hazards of 13 feet without the use of a guardrail system or personal fall arrest system. Employees were working on the 2nd level of the scaffold perforing brick work on or about 08/15/12. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a) Jobsite-1900 Popla Street - The employer did not provide each employee performing bricklaying operations from a tubular welded scaffold with training to recognize the hazards and to understand the procedures to control the hazards associated with scaffolds, on or about 8/15/12. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.
