29 CFR 1926.1101(k)(2)(ii): Building and/or facility owners did not notify persons of the presence, location and quantity of ACM or PACM, at the work sites in their buildings and facilities: (a) On or about May 21, 2012, in the West Garage, MT Investments LLC (building owner) did not identify the presence, location, and quantity of ACM/PACM, and did not inform RE Newcomb Electric, their Electrical Contractor, prior to them putting up temporary lighting by tying it to electrical pipes in the ceiling area that contained pipes with damaged, friable, thermal system insulation that contained 30 percent Chrysotile asbestos, of the location and quantity of ACM or PACM in the area. The workers were exposed to the hazards associated with asbestos. (b) On or about May 21, 2012, in the West Garage, MT Investments LLC (building owner) did not identify the presence, location, and quantity of ACM/PACM, and did not inform RE Newcomb Electric, their Electrical Contractor, prior to them splicing wire in the electrical conduit boxes located above the garage doors near a ceiling that contained pipes with damaged, friable, thermal system insulation that contained 30 percent Chrysotile asbestos, of the location and quantity of ACM or PACM in the area. The workers were exposed to the hazards associated with asbestos. (c) On or about May 21, 2012, in the East Garage, MT Investments LLC (building owner) did not identify the presence, location, and quantity of ACM/PACM, and did not inform RE Newcomb Electric, their Electrical Contractor, prior to them trouble shooting the electrical boxes located near pipes with damaged, friable, thermal system insulation that contained 25 to 70 percent Chrysotile, of the location and quantity of ACM or PACM in the area. The workers were exposed to the hazards associated with asbestos.

The workers were exposed to the hazards associated with asbestos. (b) On or about May 21, 2012, in the East Garage, MT Investments LLC (building owner) did not identify the presence, location, and quantity of ACM/PACM, and did not inform RE Newcomb Electric, their Electrical Contractor, of the location and quantity of ACM or PACM in the area. 29 CFR 1926.1101(k)(8)(vii): After the building owner or employer identified previously installed presumed asbestos containing material (PACM) and/or asbestos containing material (ACM), labels or signs were not affixed or posted so that employees would be notified of what materials contain PACM and/or ACM, and/or the employer did not post signs in lieu of labels, and/or ensure, to the extent feasible, that employees who come in contact with these signs or labels could comprehend them: (a) On or about May 21, 2012, in the West Garage, MT Investments LLC (building owner) did not post signs at the entrance into the area prior to RE Newcomb Electric, their Electrical Contractor, putting up temporary lighting and splicing wire in electrical conduit boxes. The workers were exposed to the hazards associated with asbestos. (b) On or about May 21, 2012, in the East Garage, MT Investments LLC (building owner) did not identify the presence, location, and quantity of ACM/PACM, and did not inform RE Newcomb Electric, their Electrical Contractor, prior to them trouble shooting electrical boxes. The workers were exposed to the hazards associated with asbestos.
