OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 50 feet to the ground below:    a) Site - Franklin Exchange Building - 655 N. Franklin St. Tampa, Fl.  Employees performing caulking work from a two point suspended scaffold in which the excess rope from the lifelines were found tied together exposing the employees to a 50 foot fall if the scaffold should collapse, on or about, 11/08/12.    Among other methods, one feasible and acceptable abatement method would be to:    Follow the American National Standards Institute & International Window Cleaning Association Standard I-14.1 2001 which states:    1) Section 5.8.2  Employees shall be trained in the use and care of suspended scaffolding before they are permitted to use such equipment. Training shall include but not be limited to understanding the manufacturer's instructions, inspections, assembly of components, accepted rigging practices, motor use, steel wire use, fall arrest requirements, rescue consideration and a full understanding of safe working conditions considering as a minimum, correct rigging, basic electrical concepts and care and the effects of wind on suspended operations.    2) Section 5.8.3  Prior to assembling, a competent person shall inspect the components of the suspended scaffolding and all safety devices including motors, brakes, wire rope, stirrups/hangers, decking, guardrails, electrical devices, rigging equipment, ropes, harnesses, rope grabs and lanyards for their general condition. Those components which have defects shall be immediately removed from service, tagged or marked with a label which states, " Dangerous, Do Not Use", then restored or destroyed. Improvised repairs are prohibited.    This hazard is also recognized by the Scaffold Industry Association Inc. & Scaffolding, Shoring and Forming Institute Inc; February 1998 Edition, Section D Fall Arrest Equipment which states:     1) Each person on a suspended powered scaffold must be attached to a separate fall arrest system unless the installation was specifically designed not to require one.

29 CFR 1910.106(e)(2)(iv)(d):     Flammable or combustible liquids were not drawn from or transferred into vessels, containers, or portable tanks within a building only through a closed piping system, from safety cans, by means of a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve:    Warehouse - Xylene 55 Gallon Container  Xylene was not dispensed from an approved self closing valve, on or about, 08/24/12.
