29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. a. On or about August 29, 2012 - at the above addressed jobsite, employees were performing tuckpointing operations from self made scaffolds located on the back fire escape staircase, more than twenty five (25) feet above the ground, that were not designed by a qualified person, thereby exposing the employee to a fall hazard.

On or about August 29, 2012 - at the above addressed jobsite, employees performing tuckpointing operations from self made scaffolds located on the back fire escape staircase, more than twenty five (25) feet above the ground, were exposed to injuries from falls due to the lack of fall protection.
