29 CFR 1926.1101(f)(2)(i): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace: (a) On or about May 21, 2012, in the West Garage, an employee put up temporary lighting by tying it to electrical pipes in the ceiling area that contained pipes with damaged, friable, thermal system insulation that contained 30 percent Chrysotile asbestos and the employer did not perform exposure monitoring to determine accurately the airborne concentration of asbestos which the employee may be exposed to. The employee was exposed to the hazards of asbestos. (b) On or about May 21, 2012, in the West Garage, employees spliced wire in the electrical conduit boxes located above the garage doors near a ceiling area that contained pipes with damaged, friable, thermal system insulation that contained 30 percent Chrysotile asbestos and the employer did not perform exposure monitoring to determine accurately the airborne concentration of asbestos which the employee may be exposed to. The employees were exposed to the hazards of asbestos. (c) On or about May 21, 2012, in the East Garage, an employee trouble shot the electrical boxes located near pipes with damaged, friable, thermal system insulation that contained 25 to 70 percent Chrysotile asbestos and the employer did not perform exposure monitoring to determine accurately the airborne concentration of asbestos which the employee may be exposed to. The employee was exposed to the hazards of asbestos.
