29 CFR 1926.304(d):  Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:      a)  Worksite, Interior, first floor - An employee was using a Makita Circular Saw, #5007MG, to cut lumber with the guard wedged in the open position; on or about 8/28/12.    b)  Worksite, Interior, second floor - Employees were using a Makita Circular Saw, #5007MG, to cut plywood with the guard wedged in the open position: on or about 8/28/12.        Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, Exterior - Employees were not provided with fall protection while installing plywood sheathing to the roof of a two story residential home.  Employees were exposed to a fall of approximately 35ft to the ground below; on or about 08/28/12.    b)  Worksite, Interior, First Floor - Employees were walking and working around a floor opening into the basement.  Employees were exposed to falling into the opening approximately 8ft to the ground below; on or about 8/28/12.    c)  Worksite, Interior, Second Floor - Employees were walking and working around a floor opening into the first floor of the home.  Employees were exposed to falling approximately 12ft to the ground below; on or about 8/28/12.      Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
