29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. On or about August 27, 2012 on the north side of the commercial building, employees were engaged in washing down a brick wall of a commercial building from a tubular welded frame scaffold that was not fully planked. The employees were exposed to fall hazards.

29 CFR 1926.451(e)(2): Portable, hook-on, and attachable ladders (Additional requirements for the proper construction and use of portable ladders are contained in subpart X of this part -- Stairways and Ladders). On or about August 27, 2012 on the north side of the commercial building, employees engaged in washing down a brick wall utilized the scaffold frame to egress to the lower level. The employer did not provide a scaffold ladder exposing employees to fall hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. On or about August 27, 2012 on the north side of the commercial building, employees were engaged in washing down a brick wall of a commercial building from a tubular welded frame scaffold without fall protection. The employees were exposed to a fall of 14 feet to the ground below. MR. CARLOS GALLEGOS WAS PREVISOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 316093939, CITATION NUMBER 01, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 2, 2012 WITH A FINAL ABATEMENT DATE OF MARCH 22, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 7030 HWY 78 SACHSE, TEXAS 75048.
