29 CFR 1926.451(a)(6): A front end loader or similar piece of equipment was used to support a scaffold platform that was not specifically designed by the manufacturer for such use:    (a)  Hursh Builders LLC, Arbor Rose Lane, # 32, Mount Joy, PA - An employee worked from a scaffold platform that was not specifically designed by the manufacturer to be used with a Lull 644E rough terrain forklift, on or about August 22, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(c)(2)(v):  The employer used a forklift to support a scaffold platform without ensuring that the entire platform was attached to the forks and that the forklift was not moved horizontally while the platform was occupied:    (a)  Hursh Builders LLC, Arbor Rose Lane, # 32, Mount Joy, PA - An employee was working on a scaffold platform which was approximately six (6) feet high and supported by a Lull 644E-42 rough-terrain forklift but was not attached to it, exposing the employee to a fall hazard, on or about August 22, 2012.    No abatement certification or documentation required.

29 CFR 1926.602(c)(1)(vi):  All industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation as defined in the American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks:    (a)  Hursh Builders LLC, Arbor Rose Lane, # 32, Mount Joy, PA - An operator was not posted at the controls of a Lull rough-terrain forklift (644E-42) while the forks were used to support a raised platform for an employee.  The employee was exposed to an approximate six (6) foot fall hazard, on or about August 22, 2012.    No abatement certification or documentation required.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems:    (a)  Hursh Builders LLC, Arbor Rose Lane, # 32, Mount Joy, PA - Employees working/walking on the main level of a two-level house were exposed to an approximate 9.5 foot fall hazard when the opening to the basement measuring 8.4 feet x 3 feet was not covered, on or about August 22, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.602(d):  The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter and were not followed:    (a)  Hursh Builders LLC, Arbor Rose Lane, # 32, Mount Joy, PA - Employees operating a Lull rough-terrain forklift (Model 644E-42) did not receive a combination of formal instruction, practical training, and an evaluation of the operator's performance in the workplace, on or about August 22, 2012.    ABATEMENT NOTE    The employer must certify that each operator has been trained and evaluated, with a certification that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  This evaluation must be conducted at least once every three (3) years.    No abatement certification or documentation required.
