29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposes an employee to injury and the defective or damaged item was not removed from service: a) Industrial Heating and Equipment Services, Inc. - Delta, Ohio: On or about August 28, 2012, the power supply cord for the Hobart Mega-MIG 450 portable welding machine was damaged. The equipment was not repaired or removed from service, exposing employees to electrical hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Industrial Heating and Equipment Services, Inc. - Delta, Ohio: On or about August 28, 2012, employees operated powered industrial vehicles to lift and/or maneuver larger parts and equipment in the shop. The employer did not assure that forklift operators completed a forklift operator training program containing elements in 29 CFR 1910.178(l). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
