29 CFR 1926.28(a):     The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.    a) South side of structure, east and west sides of the gable; On or about August 29, 2012 and at times prior thereto, employees utilizing pneumatic nailers to fasten shingles were not wearing eye protection/safety glasses. 29 CFR 1926.501(b)(13):     Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). Note:  If using these systems was infeasible or created a greater hazard, the employer shall develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.    a) South side of structure, east side of the gable; On or about August 29, 2012 and at times prior thereto, an employee was installing shingles on a steep pitched roof of a residential structure without a means of acceptable fall protection.    b) South side of structure, west side of the gable; On or about August 29, 2012 and at times prior thereto, an employee was installing shingles on a steep pitched roof of a residential structure without a means of acceptable fall protection.    Note: Abatement certification and documentation ARE required for these items.    Regatta Roofing, Inc. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection 479760, Citation 1, Item 1, and was affirmed as a final order on 8/15/2012 with respect to a workplace located at Lot 10, Block 9, Naipa, Boise, ID.

29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a) South side of structure, east side of the gable; On or about August 29, 2012 and at times prior thereto, an employee performing roofing work utilized a fiberglass extension ladder that was only extended approximately 2.5 feet above the roof eave for access to/from the roof.    b) South side of structure, west side of the gable; On or about August 29, 2012 and at times prior thereto, an employee performing roofing work utilized a fiberglass extension ladder that was not extended above the roof eave for access to/from the roof.    Note: Abatement certification and documentation IS required for this item.
