29 CFR 1926.453(b)(2)(v):     A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a.) Corner of Tupper and Pearl Streets, buffalo, NY - on or about 8/30/12, an employee working at an elevation of approximately 8 feet 6 inches from a truck-mounted aerial lift, was observed not wearing fall protection, as required.  the employee was exposed to a fall of approximately 8 feet and 6 inches to the concrete surface below.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Corner of tupper and Pearl Streets - on or about 8/30/12, An employees was observed in the bucket of a truck-mounted articulated lift at the height of approximately 8 feet 6" from the concrete surface below.  the employee was not wearing fall protection, as required.  The employer had not provided a training program for each employee potentailly exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.    ABATEMENT CERTIFICATION REQUIRED
