29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure for hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to employees.       a) Back of structure:  On or about August 15, 2012, and at times prior thereto, an employee without a hard hat was walking/working under or in close proximity to a Alum-A-Pole pump jack scaffold where siding activities were being performed overhead.     b) Back of structure: On or about August 15, 2012, and at times prior thereto, employees did not don protective safety glasses while utilzing a pneumatic nail gun.       Note: Abatement certification IS required for this item.
