On or about August 29, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to, employee protection when exposed to the hazards of scaffolding use and falls.

29 CFR 1926.451(d)(16): In addition to the normal operating brake, suspension scaffold power-operated hoists and manually operated hoists shall have a braking device or locking pawl which engages automatically when a hoist makes either of the following uncontrolled movements: an instantaneous change in momentum or an accelerated overspeed.    a.  On or about August 29, 2012 - at the above addressed jobsite, employees were performing tuckpointing operations from a two point suspended scaffold on the South side of the building, more than twenty five (25) feet above ground, that was not provided with a breaking device or locking pawl which engages automatically following an uncontrolled movement, thereby exposing the employee to falls.

29 CFR 1926.451(d)(17): Manually operated hoists shall require a positive crank force to descend.    a.  On or about July 10, 2012 - at the above addressed jobsite, employees were performing tuckpointing operations from a two point suspended scaffold located on the South side of the building more than twenty five (25) feet above the ground.  The manually operated hoist did not require a positive crank force to descend, thereby exposing the employee to falls.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.  On or about August 29, 2012 - at the above addressed jobsite, employees conducting tuckpointing operations from a two point suspended scaffold on the South side of the building, more than twenty five (25) feet above the ground, were not provided with safe access to the scaffold, thereby exposing the employee to falls.

29 CFR 1926.451(g)(1)(ii): Each employee on a single-point or two-point adjustable suspension scaffold shall be protected by both a personal fall arrest system and guardrail system;    a.  On or about August 29, 2012 - at the above addressed jobsite, employees were performing tuckpointing operations from a two point suspended scaffold on the South side of the building, more than twenty five (25) feet above the ground.  The employees were not protected by a personal fall arrest system and a proper guardrail system was not in place, thereby exposing the employee to a fall.
