OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by traffic hazards.    a)Church Road: Employees exposed to struck by hazards when working in an improperly set-up work zone which did not channelize traffic away from the work area.  Condition observed on or about 7/11/12    ABATEMENT NOTE: one feasible means of abatement would be to comply with the Federal Highway Administrations Manual on Uniform Traffic Control Devices (MUTCD) 2009 edition, Section 6C.05 (Transition Area) which requires that "When the redirection of the road users normal path is required, they shall be directed from the normal path to the new path". and guidance in Table "6C-3- Taper Length Criteria for Temporary Traffic Control Zones" and "6C-4- Formulas for determining Taper Length"

Condition observed on or about 7/11/12    ABATEMENT NOTE: one feasible means of abatement would be to comply with the Federal Highway Administrations Manual on Uniform Traffic Control Devices (MUTCD) 2009 edition, Section 6G.03 (Location of Work) which requires that "When the work space is within the traveled way, except for short-duration and mobile operations, advance warning shall provide a general message that work is taking place, shall supply information about highway conditions, and shall indicate how motor vehicle traffic can move through the temporary traffic control zone.". and guidance in Table "6C-1- Recommended Advanced Warning Sign Minimum Spacing" and "6C-2- Stopping Sight Distance as a Function of Speed"
