29 CFR 1910.151(c):   Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  The employer does not ensure that employees have immediate emergency access to eyewash stations when they are required to handle corrosive chemicals. This violation occurred on or about August 28, 2012 where employees were exposed to chemical hazards while handling corrosive chemicals, such as but not limited to Auto-Chlor D-Scale descaler and lime remover, without having access to an eyewash station.   Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that suitable facilities for quick drenching or flushing of the eyes are provided where employees are exposed to corrosive materials.

29 CFR 1910.157(c)(1):   Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries:  The employer does not ensure fire extinguishers are identified so that they are readily accessible.   a. This violation was observed on or about August 28, 2012 in the kitchen. (Badger fire extinguisher Model # 5MB-6H; no serial number)  b. This violation was observed on or about August 28, 2012 at the outside covered employee break/smoking area. (Badger fire extinguisher Model # B5M; no serial number)  c. This violation was observed on or about August 28, 2012 by room #116 at the end of the North Hall. (Badger fire extinguisher; no serial number)  d. This violation was observed on or about August 28, 2012 by the double doors in the North hall. (Badger fire extinguisher Model # B5M; Serial # SA-807765)  Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that portable fire extinguishers are identified.

29 CFR 1910.1030(f)(2)(iv):   The employer did not ensure that employees who declined to accept the hepatitis B vaccination offered by the employer signed the statement in appendix A:    The employer does not ensure that a declination form is signed by employees that decline the hepatitis B vaccination offered by the employer.     a. This violation occurred on or about August 28, 2012, where an employee hired on July 29, 2009, had not signed a declination form for the Hepatitis B vaccination.  b. This violation occurred on or about August 28, 2012, where an employee hired on August 1, 1997, had not signed a declination form for the Hepatitis B vaccination.   c. This violation occurred on or about August 28, 2012, where an employee hired on August 15, 2011, had not signed a declination form for the Hepatitis B vaccination.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees who decline to accept the hepatitis B vaccination sign the statement in appendix A.
