29 CFR 1910.1030(d)(2)(vii)(A): Contaminated needles and other contaminated sharps were bent, recapped, or removed: Vivage Quality Health Partners LLC, dba Aspen Care Community LLC, at 3105 W Arkansas Avenue, Denver, CO: On and preceding 8/31/12, Vivage Quality Health Partners LLC did not ensure that contaminated needles and other contaminated sharps were not bent, recapped, or removed. Certified Nursing Assistants shaved residents using disposable razors. The employer did not ensure that the employees did not recap the contaminated sharps prior to disposal in a sharps container. This condition exposed employees to a bloodborne pathogen hazard.

29 CFR 1910.1030(d)(4)(iii)(A)(2)(i): During use, containers for contaminated sharps were not easily accessible to personnel or located as close as was feasible to the immediate area where sharps were used or could be reasonably anticipated to be found: Vivage Quality Health Partners LLC, dba Aspen Care Community LLC, at 3105 W Arkansas Avenue, Denver, CO: On and preceding 8/31/12, Vivage Quality Health Partners LLC did not ensure that during use, containers for contaminated sharps were easily accessible to personnel or located as close as was feasible to the immediate area where sharps were used or could be reasonably anticipated to be found. Nurses utilized syringes to inject insulin and utilized lancets to check blood sugar levels. Nurses disposed of contaminated sharps by exiting through the resident's closed door, walking to the nurse's cart, and depositing the contaminated sharp in a sharps contain. This distance was approximately twelve to fifteen feet. The employer did not ensure that sharps containers were located as close as was feasible to the immediate area where the sharps were used. This condition exposed employees to a bloodborne pathogen hazard.

Sunburst Chemicals XP Sunshine; and 5. Sunburst Chemicals Result 100.

Nurses and Certified Nursing Assistants were occupationally exposed to blood or other potentially infectious materials. The employer did not ensure that employees who declined to accept the Hepatitis B vaccination signed a declination form.
