29 CFR 1926.102(a)(1):     Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.          a)     At the worksite, the employer did not ensure that employees were provided and used eye protection while securing shingles with a power actuated nail gun, thereby exposing employees to a potential struck-by hazard.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.          a)     On the site, the employer did not ensure that employees that were working on the upper roof area were utilizing fall protection, thereby exposing employees to an approximate 20 foot fall hazard.    b)     On the site, the employer did not ensure that employees that were working on the lower roof area were utilizing fall protection, thereby exposing employees to an approximate 11 foot fall hazard.      Jesus Braulio Sierra was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 314592775, Citation Number 1, Item Number 1 and was affirmed as final order on May 26, 2011, with respect to a workplace located at 5760 South Old State Road, Lewis Center, Oh, 43035

29 CFR 1926.1051(a):     A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.          a)     At the worksite, the employer did not ensure that employees had safe access from lower roof area to upper roof area, thereby exposing employees to a potential trip/fall hazard.      Jesus Braulio Sierra was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.1053(b)(1), which was contained in OSHA Inspection Number 314592775, Citation Number 1, Item Number 3 and was affirmed as a final order on May 26, 2011, with respect to a workplace located at 5760 South Old State Road, Lewis Center, Oh, 43035.
