Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an articulation boom aerial lift was driven over a drainage grate that could not support the maximum load. a) March Street, Easton PA - On or about August 28, 2012, the operator of a JLG 600AJ articulating boom aerial lift drove the lift over a metal drainage grate which broke under the weight of the lift causing one of the lift's front tires fall into hole causing the lift to strike the wall of a building. ABATEMENT NOTE: One feasible and acceptable means of abatement would be to follow ANSI/SIA A92.5-2006 entitled "Boom Supported Elevating Work Platforms," section 7.8 Work Place Inspections: which states, before the aerial platform is used and during use the user shall check the area in which the aerial platform is to be used for possible hazards such as, but not limited to, inadequate surface and support to withstand all load forces imposed by aerial platform in all operating configurations.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: a) March Street - On or about August 28, 2012, employees operating a JLG 600AJ articulating boom aerial lift maneuvered the lift in a manner that consistently placed parts of the non-insulated aerial lift within 10 feet from the energized 240 Volt power lines running into the building.
