OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by traffic hazards. On or about August 30, 2012-At the intersection of NYS Route 12 and Murrock Circle Employees were directed to stand in 2 different traffic lanes of oncoming traffic for the purpose of stopping vehicles hwile load vehicles negotiated the intersection: a) Employees were not provided the proper high visibility safety apparel b) Employees were not provided with the appropriate STOP/SLOW paddles as a warning to oncoming vehicles. c) Employees were not trained on the appropriate flagger procedures. Abatement certification must be submitted for this item.
