29 CFR 1910.23(e)(4):     A standard toeboard shall be 4 inches nominal in vertical height from its top edge to the level of the floor, platform, runway, or ramp. It shall be securely fastened in place and with not more than 1/4-inch clearance above floor level. It may be made of any substantial material either solid or with openings not over 1 inch in greatest dimension.  Where material is piled to such height that a standard toeboard does not provide protection, paneling from floor to intermediate rail, or to top rail shall be provided.    a. AA House Building/ Storage area above lunch room/washroom/Management's Office - On or about September 7, 2012, employees were required to work in or walk under an elevated storage area (cardboard boxes containing company's accounting records, metal tubes and parts, and wooden pallets) without a standard guardrail system equipped with a standard toeboard. Employees were thereby exposed to struck-by hazards falling from approximately 10 feet.

29 CFR 1910.110(e)(4)(iii):     Permanent and removable fuel containers shall be securely mounted to prevent jarring loose, slipping, or rotating, and the fastenings shall be designed and constructed to withstand static loading in any direction equal to twice the weight of the tank and attachments when filled with fuel using a safety factor of not less than four based on the ultimate strength of the material to be used. Field welding, when necessary, shall be made only on saddle plates, lugs or brackets, originally attached to the container by the tank manufacturer.    a. Warehouse Buildings - On or about September 7, 2012, the liquid pressure propane gas tank installed on several fork lift trucks were not securely mounted. Employees were thereby exposed to the hazards of fire and explosion. The fork lift trucks were the following;    1. The CAT # 33 (Serial # AT9012547 and Model # C 5000-LPS) fork lift truck's right latch was missing.    2. The CAT # 37 (Serial # AT9012574 and Model # C 5000-LPS) fork lift truck's left latch was missing.    3. The CAT # 38 (Serial # AT9012575 and Model # C 5000-LPS) fork lift truck's right latch was missing.
