29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) Effective jobsite safety inspections were not provided: The employer was excavating to 8 ft deep in the sidewalk to get to a sewer pipe and working on the same pipe in the cellar of the residence. The employer became aware of hazardous conditions (no ladder in the excavation; open electric panel near the pipe in the cellar) but did not abate these hazards (and/ or) remove employees from the hazard. 29 CFR 1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosure: a) Employees were exposed to electric shock hazard in the cellar of the jobsite where employees had to pass by an open electric breaker panel in that narrow hallway (3.5 ft wide) to get to the sewer pipe access pit in the floor. Employees could contact live electric parts during construction activities and when carrying tools and equipment. Location: 162 E 64th St, New York, N.Y. 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) A ladder was not provided for employees to have quick egress from the excavation in case of emergency. The employer was excavating to 8 ft deep in the sidewalk to get to a sewer pipe. The employer encountered other utility (pipe) and rocks on one side resulting that the excavation was too narrow to fit a ladder and the employee in it at the same time. The employer failed to make the hole wider/ failed to provide a ladder. Location: 162 E 64th St, New York, N.Y. 29 CFR 1926.651(k)(2): Where the designated competent person (for excavations) found evidence of a situation that could result in a possible cave-in, idications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions were to taken to ensure their safety: a) The employer did not have a designated Competent Person (for excavations) make a determination to widen the excavation when the employer found the hole was too narrow to fit a ladder in with the employee. Employee was exposed to excavation hazards (dirt, rock collapse, utilities hazards; electric, gas) when working in the 8 ft deep pit without a ladder to get out.
