29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) Neace Brothers, Inc. at 101 Ferris Lane, Erie, CO 80516: On or before September 1, 2012, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns. Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer did not develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502: a) Neace Brothers, Inc. at 101 Ferris Lane, Erie, CO 80516: On or before September 1, 2012, the employer did not ensure that employees were protected from falling in the following instances: 1) An employee was standing near the exterior top plate without the use of a pesonal fall arrest system; and 2) Employees were exposed to fall hazards caused by working near three unguarded window wall openings. Conditions exposed employees to fall hazards of up to 20 feet.
