29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. a) Work Site: 400 Passaic Avenue, E. Newark, NJ Masonry laborers were exposed to fall hazards when accessing the tubular framed scaffold platform by climbing through an adjacent window located approximately 4 feet above the scaffold working level. Violation occurred on or about 8/30/2012. IBC of Northern Jersey, Inc. dba Illescas Brothers Construction, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1910.451(e)(1) which was contained in OSHA Inspection Number 314678756, Citation 2, Item Number 2, issued on 9/19/2011 and became a final order on 10/3/2011.
