29 CFR 1910.106(h)(7)(i)(b): Class I liquids shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.    On or about August 24, 2012, the employer failed to ensure that a Class 1 flammable liquid being transferred into an intermediate bulk container (tote) was bonded and grounded.  Two employees transferred 150 gallons of methanol from 5 gallon containers into a 330 gallon capacity intermediate bulk container using a Dwyer siphon drum pump.

29 CFR 1910.106(h)(7)(iii)(c): Locations where flammable vapor-air mixtures could have existed under abnormal conditions and for a distance beyond Division 1 locations were not classified as Division 2 in accordance with Subpart S of this part:    On or about August 24, 2012 the employer failed to designated classified areas at the 1225 Peters Road plant location. Two Intermediate Bulk Container (Tote) were stored in a 8X8X20 steel storage container at the plant location. The totes contained methanol and sodium methylate. Two employees were in the steel storage container blending chemicals. The employees were using two Lasko Max performance pivoting utility fans that were not intrinsically safe.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant chemical state and physical form:      On or about August 24, 2012, at the Golden Leaf Energy, Inc. Peters Road location the employer failed to identify and evaluate respiratory hazards. Two employees were transferring methanol into an intermediate bulk container. A vapor cloud formed and filled the 8X8X20 steel storage container. One of the employees borrowed a respirator from another employee who had brought their own respirator to work.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    On or about August 24, 2012, the employer failed to ensure that eyewash and/ showers were accessible for immediate emergency use.  Two employees working in a steel storage unit were blending methanol with sulfuric acid (corrosive).
