29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.    (a) Patrick Manning LLC, 914 Broadway, Boulder, CO 80309: On and before 9/4/12, the employer did not require the wearing of protective safety-toe footwear when employees lifted approximately 200 pound red sandstone blocks.  This condition exposed the employees to injuries of the foot.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form:    (a) Patrick Manning LLC, 914 Broadway, Boulder, CO 80309: On and before 9/4/12, the employer did not evaluate the respiratory hazard of respirable crystalline silica during the installation of red sandstone.  This condition exposed employees to the respiratory hazards associated with respirable crystalline silica.        The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) Patrick Manning LLC, 914 Broadway, Boulder, CO 80309: On and before 9/4/12, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to:  	(1) Red sandstone (containing respirable crystalline silica)  	(2) Portland cement    The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.      Abatement note:  The written hazard communication program will also include:    (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) Patrick Manning LLC, 914 Broadway, Boulder, CO 80309: On and before 9/4/12, the employer did not provide effective information and training to employees regarding the health hazards associated with crystalline silica.  Employees were drilling and sawing red sandstone containing respirable crystalline silica.    The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.    Abatement note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical specific information must always be available through labels and material safety data sheets.
