29 CFR 1910.178(l)(1)(i):  The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Dedicated Diesel, LLC had employees operating powered industrial trucks, and the employer did not provide powered industrial truck operator training, as specified by paragraph (l).  This training would include the following:     a.	Formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material),  b.	Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee),  c.	Evaluation of the operators performance in the workplace.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    Dedicated Diesel, LLC had employees operating powered industrial trucks, and the employer did not conduct daily forklift inspections.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    Dedicated Diesel, LLC had hazardous chemicals at the facility, which were utilized by employees.  The employer did not provide the employees with any hazard communication training.  This training would include the following:      Information:  a.	The requirements of this section,  b.	Any operations in their work area where hazardous chemicals were present, and  c.	The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets.    Training:  a.	Methods and observations that may be used to detect the presence or release of a hazardous chemical in their work area,  b.	The physical and health hazards of the chemicals in their work area,  c.	The measures employees can take to protect themselves from these hazards, and   d.	The details of the hazard communication program developed by the employer.
