29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):    a.)  Poole Anderson Construction, 2285 Bee Line Hwy, DuBois, PA- On or about August, 22, 2012, the written Hazard Communication Program was not available at the worksite nor was there a method/procedure in place to ensure the program could be provided to employee(s) requesting access to the program while conducting work operations at job sites.  Company employees worked with and around hazardous chemicals including, but not limited to, Portland Cement.      b.) Poole Anderson Construction, 2285 Bee Line Hwy, DuBois, PA- On or about August, 22, 2012, and at times prior thereto, company employees worked with and around hazardous chemicals including but not limited to, Portland Cement.  The company's written Hazard Communication Program was missing information including, but not limited to, the following:     1.) The designation of a person responsible for overall in-plant/on-site compliance with the Company's Hazard Communication Program;     2.) The designation of a person responsible for ensuring proper labeling on incoming chemical containers;     3.) The description of the labeling system used in the plant/on job sites;     4.) The procedures to review and update label information when necessary;     5.) The designation of a person responsible for obtaining and maintaining MSDSs;     7.) A description of how the MSDSs are maintained in the plant/on job sites;     8.) A description of the training program to be used.

Poole Anderson Construction, 2285 Bee Line Hwy, DuBois, PA - On or about August, 22, 2012, Company employees worked with and around hazardous chemicals including, but not limited to, Portland Cement.  The company's written Hazard Communication Program did not include methods the employer will use to inform employees of the hazards of non-routine tasks.

29 CFR 1910.1200(e)(2):  The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii):      a.) Poole Anderson Construction, LLC, worksite at 2285 Bee Line Hwy, DuBois, PA- On or about August, 22, 2012, company employees stored and used hazardous substances that included, but were not limited to,Portland cement.  The company's Hazard Communication Program did not include the methods in which hazard communication information would be shared with employees of other employers that were potentially exposed to the chemicals used by Poole Anderson Construction employees.

Poole Anderson Construction, 2285 Bee Line Hwy, DuBois, PA- On or about August, 22, 2012, and at times prior thereto, company employees worked with and around hazardous chemicals including but not limited to, Portland Cement.  The material safety data sheet for Redi Mix Concrete was not maintained at the worksite nor was there a method/procedure in place to ensure MSDSs could be provided to an employee requesting access to the document.
