Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards which were likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from an extendable boom fork truck:    (a) On or about September 5, 2012, an employee was exposed to crushing injuries from an overturn in that, the seat belt provided in the fork truck was not being used by the operator.     Among other methods, two feasible and acceptable methods to correct this hazard are to require, and effectively enforce, the use of the seat belt provided for use by the manufacturer, and to adhere to ANSI/ITSDF B56.6-2005, Section 6.2.1, which states: "Before starting to operate the rough terrain forklift truck: (a) be in operating position and fasten seat belt, if so equipped;"    (b) On or about September 5, 2012, employees were exposed to crushing injuries from an extendable boom fork truck that was moving containers of stucco on and off a scaffold over the heads of the employees working on an elevated surface and on a scaffold.      Among other methods, two feasible and acceptable methods to correct this hazard are to require, and effectively enforce, work rules to remove employees from the location where the fork truck loads and unloads, and to adhere to ANSI/ITSDF B56.6-2005, Section 6.2.7, which states: "Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded."

29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a)  On or about September 5, 2012, and at times prior, employees working below work activities on upper levels of a scaffold were not protected from falling objects in that they did not wear hard hats. 29 CFR 1926.451(b)(1):  Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports:    (a)  On or about September 5, 2012, and at times prior, employees were not protected from fall hazards in that the scaffold they were using was not fully planked in various locations including on the top level where a worker stood on one scaffold plank that reached between the frames on the east end of the scaffold that covered the Big Lots store wall.
