29 CFR 1903.19(c)(1):  Within 10 calendar days after the abatement date, the employer did not certify to OSHA that the cited violation had been abated:     On October 18, 2012, Minh Le dba M.T. Construction, was issued citations and the employer did not verify, through written certification that each citation was abated.  Abatement certification was not received for the following violations:      a.	Citation 1 Item 1,   b.	Citation 1 Item 2, and   c.	Citation 1 Item 3.

29 CFR 1910.134(c)(2)(i):     Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    At the jobsite located at 1500 East Empire Street, Bloomington, IL, employees were voluntarily wearing 3M 8210 filtering facepiece respirators while jackhammering concrete and the employer failed to provide employees with the information contained within Appendix D of the respirator standard prior to allowing the respirators to be worn.
