29 CFR 1926.1101(k)(3)(ii)(B): The employer did not inform employees who performed work under 29 CFR 1926.1101 of the location and quantity of asbestos containing material and/or presumed asbestos containing material present in the area: a) On or about August 24, 2012, the employer, Monarch Investment and Management Group, LLC d/b/a Meadowlark Apartments, did not provide information to maintenance employeees, who are required to perform Class III asbestos work in apartment units, regarding the location and quantity of on-site asbestos containing material and/or presumed asbestos containing material.

29 CFR 1926.1101(k)(9)(v): Training for Class III employees was not consistent with EPA requirements for training of local education agency maintenance and custodial staff as set forth in 40 CFR 763.92(a)(2). Such a course did not include also "hands on" training and did not take at least 16 hours: a) On or about August 24, 2012, the employer, Monarch Investment and Management Group, LLC d/b/a Meadowlark Apartments did not ensure employees, who were required to engage in repair and maintenance operations where surfacing asbestos containing material was or was likely to be disturbed, were provided the required training for Class III asbestos operations.
