OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. (a) The employer failed to ensure adequate Employee(s) did not perform inspections of vertical life-line ropes and suspension ropes before their use in a Rope Descent System (RDS). Defective rope was provided for use and was abraded exposing its internal structure. (b) The rope used as both the personal fall arrest anchorage and as the suspension rope in an RDS was exposed to abrasion from sharp edges on the rooftop without adequate padding to protect all such rope lengths.

29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed. (a) Employees were exposed to an approximate 20 story fall hazard performing window washing activities and the employer did not ensure that the personal fall protection equipment was safe for the work that needed to be performed.
