OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed toto tip over and fall hazard: On or about 9/06/2012, at the intersection of Goolette-Frank Rd and Orange Blossom Dr. in the city of Naples, FL; an employee was engaged in palm trimming work from a Polecat ST 266 aerial lift at approximately 15 feet above ground level which was not being use as specified by the manufacturers instructions, exposing employee to tip over and fall hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees to elevate the boom on side slope surface as specified by the manufacturer's instructions (danger signs on the equipment). NOTE: CERTIFICATION OF ABATEMENT MUST BE SUBMITTED FOR THIS ITEM.
